  • Defense of tugboat company in a maintenance and cure trial involving a Honduran seaman with an enlarged heart; medical investigation, discovery, and several depositions all conducted in Honduras
  • Defense of dredging company in a seaman’s personal injury jury trial alleging Jones Act negligence, unseaworthiness, maintenance and cure, and the arbitrary and capricious denial of maintenance and cure benefits pending in Texas state court in Rio Grande City, Starr County, Texas, total judgment in the amount of $39,000.00
  • Seven day limitation of liability and three personal injury claimants’ trial conducted in the Western District of Louisiana
  • Summary judgment granted in favor of our client, the defendant ship cleaning company, against plaintiffs who alleged $1.75 million of damages for breach of contract, negligence, indemnity, and contribution with respect to our client’s performance of ship cleaning operations to obtain U.S.D.A. passes for the loading of grain cargo, on the grounds that the contract terms were fully satisfied and no duty was breached
  • Summary judgment granted in favor of our client, the defendant promoter, against plaintiffs alleging antitrust and civil rights violations, on the grounds that plaintiffs failed to present any evidence to support their several causes of action under the Sherman Act and Civil Rights Act (Southern District of New York, Judge Patterson’s opinion at 2005 WL 22833, affirmed on appeal, Rowe Entertainment, Inc., et al. v. The William Morris Agency, Inc., et al., 167 Fed. Appx. 227, 2005 WL 3579360, Second Circuit Court of Appeals)
  • Summary judgment granted in favor of our client, the defendant vessel owner, against personal injury plaintiff alleging negligence under 33 U.S.C. 905(b), on the grounds that none of the three Scindia duties owed by our client to the plaintiff were violated (Eastern District of Louisiana, Judge Fallon’s opinion at 2003 WL 2012382, affirmed on appeal, Pledger v. Phil Guilbeau Offshore, Inc., 88 Fed. Appx. 690, 2004 WL 249597, Fifth Circuit Court of Appeals)
